A psychotherapist is trying to quieten children at a day nursery – after complaining that they play outside too loudly and for too long.

Jayne Tibbott, 53, is seeking a noise abatement order against Hove Village Nursery, next to her £1million detached home.

The nursery opened four years ago – a decade after Mrs Tibbott bought the four bedroom house with her husband Barry, who is a dentist, in Hove, East Sussex.

Mrs Tibbott, who sees clients at a clinic almost two miles away, has been in private practice as a psychotherapist and clinical supervisor for 13 years, with child-related issues as one of her specialist areas

The nursery and her home, which has a swimming pool in the rear garden, both back on to a park with football pitches.

According to court papers, Mrs Tibbott is taking a private prosecution against the nursery, claiming ‘excessive noise from children playing outside for long periods’.

Her complaint could lead to the nursery being forced to cut outdoor playtime – and leave bosses facing a fine of up to £5,000 if any noise abatement order was breached.

Private prosecutions can be taken by residents who claim they are ‘aggrieved by noise’ that amounts to ‘a statutory nuisance’.

They can complain directly to a magistrates’ court under the Environmental Protection Act 1990.

My view: I wonder if she has something else to do apart from complaining about ‘excessive noise from children playing outside for long periods’.
